Purshottam Kanji Exchange Co. LLC (PKE) – Terms & Conditions
These Terms and Conditions ("Terms") govern your use of the services
provided by Purshottam Kanji Exchange Co. LLC ("PKE", "We", "Us", or
"Our"), including but not limited to PKRemit ("Service"). By accessing or
using this Service, you agree to be bound by these Terms.
PKE is a company incorporated under the laws of the Sultanate of Oman and
regulated by the Central Bank of Oman (CBO), with its registered office at
P.O. Box 41, PC 100, Ruwi High Street, Muscat, Sultanate of Oman.
PKE reserves the right, at its sole discretion, to amend, update, or
modify these Terms at any time. Any such changes will be effective upon
publication.
1. Eligibility
To use the Service, you must:

Be a resident of Oman holding a valid Resident Card;

Hold an active account with a licensed bank in Oman; and
-
Complete registration with PKE for access to the Service.
By using the Service, you confirm that you meet the above requirements.
You agree to indemnify PKE for any losses or liabilities resulting from
use of the Service if these conditions are not met.
2. Electronic Communication
As this is an online service, you consent to receive communications in
electronic form, including but not limited to:
- These Terms and any future amendments;

Transaction records, receipts, and confirmations;

Notifications, alerts, and customer service responses;
-
Any communication required by law or regulation.
You are responsible for ensuring that your contact details, including your
email and mobile number, are kept up to date.
3. Exchange Rates and Charges

Transactions are processed at the prevailing exchange rate at the time
of execution.

Commission and service charges are disclosed on your transaction receipt
and may change without prior notice.

Correspondent, intermediary, or beneficiary banks may apply additional
charges beyond PKE’s control. In such cases, the beneficiary may receive
less than the amount sent.

PKE shall not be held liable for charges levied by third-party banks.
4. Non-Execution of Transactions
We may decline or delay a transaction if:

Authorization is not received from your bank or card issuer;
- You breach these Terms;
-
A regulator, law enforcement body, or court instructs us to do so;
-
Required by law or regulation in Oman or abroad;
-
Prevented by circumstances beyond our control (e.g., natural disasters,
technical failures, strikes, war, terrorism, regulatory restrictions).
5. Refund Policy

Refunds are issued at PKE’s discretion and subject to applicable
deductions.

Refunds due to customer error will be made at the prevailing buying rate
on the refund date.

If the refund arises from PKE’s error or negligence, the full
transaction amount will be returned.

Refunds are issued only via cheque in the Sender’s name if the payment
is made through banking channel (except cash mode).
6. AML/CTF and Sanctions Compliance
PKE is fully committed to compliance with Anti-Money Laundering (AML),
Counter-Terrorism Financing (CTF), and Sanctions Regulations. Accordingly:

Transactions may be delayed, blocked, or declined if they appear to
involve prohibited activities, sanctioned parties, or unlawful conduct.

You must provide complete and accurate information and cooperate with
any verification requests.

PKE may disclose transaction or customer information to regulators, law
enforcement agencies, or correspondent banks as required by law.

Unless otherwise disclosed, you confirm you are acting on your own
behalf and not as an agent for an undisclosed third party.
7. Warranties and Indemnities
By using the Service, you warrant that:

All information and documents provided are true, accurate, and complete;

You will comply with all applicable laws and regulations;

You are solely responsible for safeguarding your login credentials and
access details;
-
You are not acting for any undisclosed third party.
You agree to indemnify PKE against all claims, losses, damages, costs, or
liabilities arising from:

Delays, errors, underpayments, or non-delivery of transactions (except
where caused by PKE’s negligence);
- Breach of these Terms;
-
Misrepresentation of your eligibility or transaction purpose.
8. Privacy and Data Protection

PKE processes personal data in compliance with Omani laws and
regulations.

Your data will be used strictly for service delivery, compliance, and
other lawful business purposes.

Records are securely maintained for 10 years as per CBO requirements.

You have the right to request copies of records related to your
transactions.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Sultanate of Oman. Any
disputes shall be subject to the exclusive jurisdiction of the courts of
Oman.
